A Tulsa homeowner has been arrested after he shot a man who he claimed was trying to break into his house near 81st and Harvard, according to Tulsa Police.
Police say, David Roland, has been arrested because he appears to have chased the suspected burglar down the street before shooting them once in the stomach. Tulsa Police say they got a call from Roland around 3:15 Monday morning saying he had just shot someone who was trying to break into his house. Roland later told Detectives that he was going to bed when he heard a car driving down the street. Roland said he assumed it was a burglar and stated to detectives that no one drives through the neighborhood at that time unless it's a thief.
Roland said he saw someone park a silver car park around the corner and get out and at that point, he walked out of his house with a flashlight, a gun. and a cell phone. Roland told police that he saw a man, run from his driveway carrying items. Roland said he yelled at the man to stop, but the man instead ran to his vehicle 50 yards away. Detectives say that Roland told them that he chased the man to the car and then pointed his flashlight and his gun at him and told him to show him his hands. Roland said they got into a short shouting match and when the burglary suspect stepped forward, he shot him in the stomach.
Roland was taken downtown to be interviewed by detectives and then arrested for Assault with a Deadly Weapon. Detectives say the arrest was made because Roland had already chased the suspect away before shooting him, which would not meet the requirements of Oklahoma's "Make My Day" Law. The Tulsa County District Attorney's Office was presented with the evidence and determined that Roland discharged his firearm illegally.
The man who was shot is at the hospital and is expected to survive. Detectives say the shooting victim did not actually steal anything from Roland but did break into a car next door. They say he will be arrested for burglary when he is released.
